Amidst the ongoing rhetoric about the collegium system, the Supreme Court said that the comment against it is not right. It is the law of the land and everyone should follow it. The court was hearing a petition related to the names sent by the collegium to the government for the appointment of judges in the courts of the country. In which it was said that the Central Government is delaying in approving the names of the judges sent.
The court asked when will the dispute between the government and the collegium system be resolved? As long as the collegium system is there, as long as it is maintained, work will have to be done according to it. If you want to bring a new law, no one stops you. If a section of the society starts deciding which law will be followed and which will not, then there will be trouble. When the government makes a law, you expect the courts to enforce it until the law is struck down.
The court advised the government
A bench headed by Justice SK Kaul is hearing the matter. It also includes Justices AS Oka and Vikram Nath. The bench asked Attorney General R Venkataramani to advise the government in this regard. He said that we hope that you will explain to the government that the legal principles laid down by the court should be followed.
Earlier on December 2, the Supreme Court had said that the collegium system cannot be derailed on the basis of statements of people who are interested in the work of others.
There are 5 members in the Supreme Court Collegium
The Collegium consists of 5 members. CJI is the head in this. Apart from this, there are 4 most senior judges. Its members include CJI UU Lalit, Justice D.Y. Chandrachud, Justice S.K. Kaul, Justice S. Abdul Nazeer and Justice KM Joseph. It is the collegium that appoints judges to the Supreme Court and High Courts and recommends their names to the Centre.
