Former Delhi Deputy CM Manish Sisodia said on Friday that Prime Minister Narendra Modi should follow the Constitution. His remarks came after the Supreme Court’s decision on the issue of transfer-posting of bureaucrats in Delhi. On May 11, the Supreme Court had said that the Delhi government has legislative and executive powers over the services.

The AAP leader was produced before Delhi’s Rouse Avenue Court on May 12 after his remand in the CBI case was over. The court extended his judicial custody till June 2. The court will also consider the CBI charge sheet on the next date. While leaving the court, Sisodia gave this advice to the PM while answering questions from the media.

What did the Supreme Court say in the judgment?
There was a long-standing dispute between the Delhi government and the Center over the transfer-posting of bureaucrats. On May 11, a 5-judge bench of the court had said in its order that except for public order, police and land, the lieutenant governor would act on the advice of the Delhi government in all matters.

The court had also said that if the elected government does not have the power to control the officers, the officers stop reporting to the ministers or do not follow their instructions, then the rule of accountability will be lost. The court empowered the Delhi government to do the posting and transfer of officers on its own. The Delhi government will also be able to enact laws on issues on which there are no central laws. Verdict reserved on Sisodia’s bail
On the other hand, on May 11, the Delhi court reserved the verdict on Sisodia’s bail in the CBI case. Sisodia had filed a petition seeking interim bail citing his wife’s ill health. Sisodia’s bail plea timeline in CBI case

  • On March 31, Special Judge MK Nagpal in Delhi Court rejected Sisodia’s bail plea in the CBI case.
  • On April 5 itself, Sisodia filed a bail application in the Delhi High Court seeking bail in the CBI case.
  • During the hearing on the bail plea on April 6, Justice Dinesh Sharma of the Delhi High Court sought the response of the CBI. Also, the hearing was listed for April 20.
  • On April 20, the hearing on Sisodia’s bail plea in the CBI case was adjourned till April 26. The CBI was to present its arguments on the next date.
  • On 26 April, the agency presented its arguments in the court. The court fixed the date of April 27 for the next hearing.
  • On 27 April the court hearing was adjourned till 28 April. At the same time, on 28th the hearing was adjourned till 3rd May.

CBI is probing irregularities in liquor policy case. The agency arrested Sisodia on February 26 after eight hours of questioning. Since then he is in the custody of the agency. Earlier on March 31, the sessions court of Delhi had rejected his bail plea. Then Sisodia had approached the High Court for bail.

Hearing on ED’s charge sheet against Sisodia on May 19
The hearing on the fifth charge sheet filed by the ED against Manish Sisodia in the Delhi Liquor Policy case on May 10 has been postponed. Now the Rouse Avenue Court will hear the case on May 19. Let us tell you that on May 4, the investigating agency had filed the fourth supplementary (fifth charge sheet) in the court. In which ED made Sisodia an accused for the first time and said that he is the main conspirator in this case.

Earlier, the investigating agency had alleged in the third supplementary charge sheet that some big leaders of Aam Aadmi Party and BSR leader K. Kavita was a conspiracy of the so-called ‘South Group’ comprising YSR Congress MPs. The ED had claimed in the second supplementary charge sheet filed in the court that Vijay Nair and several leaders of the Aam Aadmi Party were acting at the behest of Manish Sisodia.
