Governor Punjab Banwarilal Purohit and Chief Minister Bhagwant Mann have once again come face to face regarding whether the special session of the Punjab Legislative Assembly is constitutional or non-constitutional. Where the governor of Punjab wrote a letter in the past days seeking opinion on the session and termed it unconstitutional for the second time. On the other hand, CM Mann has talked about passing all the four bills and waiting for a while.

The Chief Minister had arrived at the inauguration of newly built hostels in Punjab University. CM Mann said- Not only the appointment of University Vice Chancellor, all four bills (Sikh Gurdwara Act 1925 Amendment, Punjab Police Amendment Bill, University Law Amendment Bill and Punjab Affiliated Colleges (Security of Services) Amendment Bill) are still pending.

The governor had written another letter on the previous day itself.

The Governor had written the second letter to the Chief Minister on the previous day itself. Said-

Quickly reply to my letters which you were calling love letters in the Vidhansabha. According to the constitution, the CM is bound to reply to the letters given by the Governor. Not replying to my letters is a violation of Article 167 of the Constitution.

The governor wrote to the CM in a warning tone that many complaints of corruption are coming to him. So reply to my letters as soon as possible otherwise it will be considered as a violation of the constitution

It is very unfortunate that it is being said in the media that the Governor did not take any legal opinion regarding the assembly session. He said that I want to bring to your notice that the Vidhansabha session was called on 19th and 20th June for which opinion was taken from an expert of the constitution.

For your information, the essence of the opinion given by him is also being attached, in which he has clearly written that the called assembly session was completely illegal. There is nothing left to respond to your comments now.

Special session was held on 19 and 20 June

A special session of the Punjab Legislative Assembly was called on June 19 and 20 and four bills were passed. After this, the Chief Minister had urged the Governor to approve these four bills, but the Governor flatly refused and said that he is taking advice from the Attorney General and other legal experts as to what should be the final decision on these bills?

After this, on July 15, the Chief Minister wrote a letter to the Governor asking him to give his assent to the four bills with immediate effect. Responding to the Chief Minister’s letter, the Governor had written, ‘I have many grounds to believe that the assembly session, in which the four bills were passed, was in violation of law and legal process.

This raises doubts on the validity and legality of those bills. The governor did not stop here. He further wrote that it is evident from your letter that you are concerned about certain actions of a particular political family, which has prompted you to get the bill passed against them in the assembly. This is also a matter of concern.

  • The Sikh Gurdwara Amendment Bill – 2023: Under this, the Gurbani to be held at the Golden Temple in Amritsar will be broadcast free of cost worldwide. Till now only PTC channel had the right to broadcast Gurbani. Members of Congress and BJP were not present in the House during the passing of this bill while the Akali Dal opposed the bill. The Chief Minister himself introduced this bill in the House.
  • Punjab Police (Amendment) Bill-2023: After this bill, the Punjab government will now be able to appoint the Director General (DGP) of Punjab Police on its own. For this, the government will form a committee in which former Chief Justice or former judge of Punjab and Haryana High Court will be the chairman. The committee will make a panel of three officers for DGP, out of which one will become DGP. The Chief Minister himself introduced this bill in the House.
  • Punjab University Law Amendment Bill – 2023: Through this bill, the Chief Minister was given the right to appoint the Vice Chancellor (VC) of the universities run by the Punjab government. Earlier this authority was with the Governor. This bill was introduced in the House by Education Minister Harjot Bains.
  • Punjab Affiliated Colleges (Security of Services) Amendment Bill-2023: This bill was introduced in the House by Education Minister Harjot Bains.
