The Gyanvapi case has now taken a new turn. A new petition has been filed in the Supreme Court challenging the constitutional validity of certain sections of the Warship Act 1991. These sections of the Act are violative of the principles of secularism and rule of law, the petition said. This petition has been filed by religious leader Swami Jitendranand Saraswati.

Swami Jitendrananda challenged the constitutional validity of Sections 2, 3, 4 of the Places of Worship Act in the petition. He says, the sections violate Articles 14, 15, 21, 25, 26, 29. It also violates the principles of secularism and rule of law. The petition states that sections 2, 3, 4 of the Act have taken away the right to approach the court.

Section three of the Places of Worship Act 1991 prohibits the transformation of places of worship. It has been clarified in the section that no person shall convert a place of worship of any religious denomination into a place of worship of a different class of the same religious denomination or of a different religious denomination or any class thereof.

At the same time, Section 4 of the Act prohibits the filing of any case or initiation of any other legal proceeding for the transformation of the religious character of any place of worship.
