Three Acts related to prisons have been reviewed and some of their provisions have been included in the ‘Model Prisons Act, 2023’.

The Ministry of Home Affairs has finalized the Model Prison Act 2023 for the improvement of prison arrangements and prisoners. With this, the 130-year-old prison law of the British era will be changed. The Ministry of Home Affairs issued a statement on Friday informing about the finalization of the new Act. The Ministry also reviewed the Prisoners Act 1900 and the Prisoners Transfer Act 1950 and their provisions have been included in the new Act.

There will be transparency in jail management

In the new Act, more emphasis will be laid on the safety of women and transgender prisoners, this will bring transparency in prison management and provision has also been made for the reformation and rehabilitation of prisoners. The statement said that the existing ‘Prisons Act 1894’ dates back to before independence. It mainly focuses on the detention of criminals and enforcement of discipline and order in prisons and has no provision for reform and rehabilitation of prisoners.

Who prepared the new prison law
The Ministry says that there are many loopholes in the existing Prisons Act and a need was felt to amend the Act keeping in view the needs of modern times and the requirements of prison management. After which the Ministry entrusted the responsibility of making recommendations for amendment in the Prisons Act 1894 to the Bureau of Police Research and Development and the Bureau prepared its draft after much discussion with the State Prison Administration and some experts.
