On February 17 this year, the Election Commission had ordered that the party’s name Shiv Sena and election symbol arrow-bow would remain with the Eknath Shinde faction.

Eknath Shinde will remain the CM of Maharashtra. The climax of Maharashtra’s political drama, which has been going on for 11 months, took place on 11 May 2023 in the Supreme Court. The Supreme Court said that Uddhav Thackeray did not face the floor test. He resigned of his own free will, so the court cannot restore the old government.

Elections were held in 2019 on 288 assembly seats in Maharashtra. BJP became the single largest party in the state with 106 MLAs. Shiv Sena and BJP could not talk about the Chief Minister’s post in the alliance. Shiv Sena with 56 MLAs joined hands with Congress with 44 MLAs and NCP with 53 MLAs to form Maha Vikas Aghadi.

Shinde was among those Shiv Sena leaders who were against forming a government with the Congress. In 2019, Uddhav made Shinde the leader of the legislative party. At that time it was believed that Shinde would become the CM of Maharashtra, but NCP and Congress wanted to make Uddhav the Chief Minister. In this way, Shinde kept on becoming the Chief Minister of Maharashtra.

In May 2022, Urban Development Minister and Shiv Sena leader Eknath Shinde rebelled along with 39 MLAs in the Maharashtra government. Eknath Shinde took advantage of the Nabam Rebia case of Manipur, in which the Supreme Court had formed the government of rebel MLAs. Simultaneously, Shinde gave a notice of no-confidence motion against the Deputy Speaker in the Maharashtra Legislative Assembly. So that the Deputy Speaker could not take a decision on the disqualification of 16 MLAs of Shinde faction.

Meanwhile, the governor asked Uddhav Thackeray to prove his majority. Uddhav went to the Supreme Court against this, but the Supreme Court upheld the Governor’s decision. After this Uddhav had resigned. The Governor has now asked the Shinde faction to prove its majority immediately.

29 June 2022 : Uddhav Thackeray resigns as chief minister, bringing curtains down on nine days of political turmoil triggered by a rebellion by the Shinde group.

The Supreme Court had told Uddhav Thackeray that he would have to prove the next day that his government still had a majority. Thackeray resigned minutes after this decision.

3 July 2022 : A two-day special session of the Maharashtra Legislative Assembly was called. BJP MLA Rahul Narvekar was elected speaker.

4 July 2022 : Shinde won the assembly by 164 votes and 99 votes in his favour.

8 October 2022 : Ahead of the Andheri (East) assembly by-election on 3 November, the Election Commission ordered the freezing of the Shiv Sena’s ‘Tir Kaman’ election symbol. After this, the Thackeray faction was given the burning torch election symbol and the name “Shiv Sena- Uddhav Balasaheb Thackeray”. The Shinde faction was given the name “Balasahebchi Shiv Sena” and the election symbol of two swords and a shield.

17 February 2023 : The Election Commission ordered that the name of the party ‘Shiv Sena’ and the election symbol of the party ‘bow and arrow’ would remain with the Eknath Shinde faction. The commission found that the present constitution of Shiv Sena is undemocratic. Because the Uddhav group had undemocratically appointed its people as office bearers without conducting elections.

Shinde, who went to Goa with 49 rebel MLAs, released a photo. After this speculations were made that if Uddhav resigns then the path of Shinde and BJP will become easier. Taking all this, he can go to the Election Commission and stake a claim on the symbol of Shiv Sena. That’s what happened. Subsequently, on February 17, 2023, the Election Commission ordered that the name of the party ‘Shiv Sena’ and the election symbol of the party ‘bow and arrow’ would remain with the Eknath Shinde faction.

On both March 16 and May 11, the Supreme Court said that Uddhav had resigned voluntarily. In such a situation, the court cannot cancel the resignation.
