Haryana, Jharkhand, MP, Andhra, Karnataka and Maharashtra have even announced reservation of up to 75% for local people in private jobs. However, it has not been fully implemented in any state.

Somewhere it is stuck in the court, and somewhere there is no special benefit due to lack of monitoring system. Meanwhile, Jharkhand has announced that from January 2023, it will be mandatory to employ local people in 75% of the posts with monthly salary up to 40 thousand in private companies. This will apply to all companies with more than 10 employees. Violation will attract a fine of 5 lakhs.

  • There are more jobs in the private sector, so opportunities will increase for the local people. Will not be forced to leave the state.

Argument against reservation: skilled employees will not be able to get

  • It can be difficult for companies to find skilled employees. They can move towards other states. Economic growth may slow down due to reduced investment.
  • It is also against the fundamental right, in which any citizen has been given the exemption of employment anywhere in the country.
  • Due to the restriction of keeping the local people, they will have to pay more wages. Ease of doing business will take a hit. The freedom of industries will be snatched away.
  • An atmosphere of tension can be created between local and external employees, which will also affect their productivity.

  • The Supreme Court said in a decision – Reservation given on the basis of place of residence does not violate Article 15. Because there is a difference between ‘birthplace’ and ‘place of residence’. Articles 15(1) and 15(2) prohibit any discrimination on the basis of place of birth, not the place of residence.
  • The Punjab-Haryana High Court had imposed a stay on the reservation of 75% local people in private jobs by the Haryana government, later gave relief. But the case is still pending.
  • According to legal experts, the court will have to decide a reasonable scope of reservation so that a balance is maintained between the rights of both local and outsiders.
