In the event of failure to prove majority, Uddhav Thackeray will have to resign from the post of Chief Minister.

Political upheaval continues in Maharashtra after the rebellion of the second big leader of the Maharashtra government, Eknath Shinde. Due to the government coming in minority, the matter is now moving towards the dismissal of the assembly. Now in such a situation many questions arise whether Chief Minister Uddhav Thackeray can sack the assembly? What will happen after his resignation? What will be the governor’s decision? To know the answers to these questions, Bhaskar spoke to senior journalists from Maharashtra Deepak Bhatuse and Vijay Chormare. Here are excerpts from his conversation…

Thackeray government cannot dismiss the assembly
In a conversation with Bhaskar, senior journalist Deepak Bhatuse said that the Thackeray government with minority cannot dismiss the assembly. The government can recommend it to the governor. After that the final decision is to be taken by the Governor only. Eknath Shinde says that he has more than 40 MLAs. But, the danger for them too is how many of these MLAs can stay with them till the Thackeray government proves its majority.

…then Thackeray will have to resign
According to senior journalist Vijay Chormare, the Thackeray government will have to prove majority due to Eknath Shinde’s claim of support of the MLAs. If he is not able to do so then he will have to resign from the post of Chief Minister. As a precaution, the Governor can impose President’s rule for some time. If during this time again the MLAs come to the court of Uddhav government, then the government can come to power again.

The journey ahead for angry MLAs is not easy
The present government is in a minority due to the formation of separate factions of about 40 MLAs. So he has to resign. If there is no possibility of an alternative government being formed, then the Election Commission will have to hold mid-term elections. However, it is certain that Shiv Sena will not give tickets to these MLAs in the next elections. So will BJP give him a ticket? Due to this, the political journey of these MLAs will not be easy in the midterm elections.

What is the role of the Governor?
As the head of the constituent state, the powers of the governor are limited to the state. As the constitutional head of the state, the governor has the power to appoint the chief minister, other ministers, members of the state public service commission, etc. If the law and order situation in the state deteriorates or a constitutional deadlock occurs due to the fall of the government, the Governor can recommend to the President the imposition of President’s rule in the state according to Article 356 of the Constitution.
