A parent from Gujarat living in Germany has been yearning to caress their daughter for 10 months. In fact, their 17-month-old daughter is in the possession of the German Protection Authority and the parents are not even allowed to meet her. Parents are constantly pleading with the authorities of the authority, but till now no hearing has been done. The parents have also appealed to the Indian Embassy in Berlin for help several times.

what is the matter
Dhara Shah’s 7-month-old daughter, originally from Gujarat, was bleeding from her private part due to some injury. When Dhara saw blood in the daughter’s diaper, she immediately reached the hospital with the daughter. The hospital authorities initially refused treatment, saying the injury was common in children. Dhara brought the daughter home, but the same problem persisted on the second day, so Dhara again reached the hospital. Meanwhile, the hospital staff informed the child protection officers about it. The authorities handed over the girl to the German Child Protection Authority on suspicion of sexual abuse with the girl. However, the medical examination revealed that there was no sexual abuse with the girl.

The daughter was born in February 2021.

Authority is now seeking certificate of ‘fit to be parents’
After this the authority refused to give the custody of the daughter saying that you will have to first produce a certificate of fit to be parents. Dhara and Bhavesh have so far attended two sessions of the Legal Authority. But, the legal process of ‘fit to be parents’ is not over yet.

Bernil shifted in 2018
Dhara, who lives in Ghatlodia, Ahmedabad, is married to Bhavesh Shah of Mumbai. Bhavesh is a software engineer who got a job in an IT company in Berlin in 2018. Due to this, both were shifted to Berlin. In Berlin itself, in February 2021, the cry of daughter resonated at his house. The daughter was seven months old. Dhara’s parents had come to meet the granddaughter. During this, the daughter was hurt and this accident separated the daughter from the family.

What is the fault of my innocent daughter: Dhara
‘My daughter is only 17 months old. After all, what is his fault in that he is being punished. What would be more sad for us than this that in spite of us, the daughter is living life like an orphan. Far from loving her for the past 10 months, we haven’t even been given a chance to catch a glimpse of her. He needs mother’s milk, needs our pampering and caress. But, like an orphan, she is in the custody of the German Child Protection Authority.

Can’t meet despite being in the same country?
At the same time, Dhara’s mother told about this that since the daughter got separated. A mountain of sorrow has fallen on the entire family. Daughter Dhara does not have peace for even a minute. She keeps pleading to see her daughter all the time. After all, what is such a law of this country that even after living in a country, an innocent girl is not being allowed to meet her parents. If the authority considers the fault of the parents, then hand over the daughter to us. We’ll take care of him.

A case is also going on in the civil court of Berlin for the custody of the daughter.

appealed to the Indian embassy
The family has been wandering for the last ten months to bring back the daughter, but till now no help has been received. The family has also approached the Indian Embassy in Germany. He promised to cooperate in this matter. But so far no concrete action has been taken. A case has also been registered in the civil court to get the daughter back and they are also fighting a legal battle.

Daughter custody can take a long time
The girl’s father, Bhavesh Shah, says that according to German law, based on the Continuity Principle, if the child stays with the German Child Protection Authority for a long time, he becomes adapted to local customs and the environment. Such as eating, drinking, living there, talking etc. In such a situation, the child can remain with the authority for a long time. So it may take us a long time to get custody of the daughter.
