Will Rahul Gandhi’s sentence of 2 years in the Modi surname case continue or be stayed, a decision will come today. After hearing the arguments of both the parties in the sessions court of Surat on Thursday, the court had reserved the verdict.

Additional Sessions Court Judge RP Mogera had granted exemption to Rahul Gandhi not to be present during the hearing. Rahul’s lawyer RS ​​Cheema argued in the court that the defamation case regarding the remark was not proper. Also, there was no need for maximum punishment in the case.

Cheema said that Section 389 of the Criminal Procedure Code provides for suspension of sentence pending an appeal. He said- Power is an exception, but the court should consider the consequences of the sentence. He said that the court should consider whether the convict will suffer more. It is unjust to get such a punishment.

Petitioner Purnesh Modi, in his reply filed in the court, opposed Gandhi’s plea saying that the Congress leader is used to making defamatory statements repeatedly. Earlier, on April 3, the court had granted interim bail to Rahul on a bond of Rs 15,000. Rahul had filed a main petition and two applications in the Surat court.

First Application: In one, a stay was sought on the sentence. Accepting this, the court granted interim bail to Rahul. The court said that this bail will remain till the decision on this application.
Second Application: In this, a stay was sought on the conviction. On this, the court said that no order can be passed without hearing the other side. Hearing is being held on this today.
