Maharashtra Chief Minister Eknath Shinde faction claimed Shiv Sena on Tuesday. The Shinde faction said that the Legislature is an integral part of the political party and it is organically linked to the party.

Senior advocate NK Kaul, on behalf of the Shinde group, said that our opposition group has no faith left in the cabinet. On this answer, the Supreme Court said that the Shinde faction should show us its political majority.

On this matter of the Supreme Court, today the Shinde group will present its stand in front of the bench of CJI DY Chandrachud, Justice MR Shah, Justice Krishna Murari, Justice Hima Kohli and Justice PS Narasimha.

Supreme Court’s questions and Shinde group’s answers
Supreme Court: CJI Chandrachud said, ‘If we accept this argument of yours, very strange results will emerge. On the one hand we have the Constitution, which prevents constitutional sins like rebellion from the party. On the other hand you say that whatever causes division should be disqualified. At the same time you also say that even if that person is responsible for the disqualification, he can still participate in the trust voting in the House.

Supreme Court: The CJI said, “The test floor situation was created because a group of MLAs could have been disqualified because of split in the party. When the validity of the split in the party is in question, are you not going to benefit the disqualification process?” Are you using it?’

Shinde faction: NK Kaul said, “It is not a case of split in the party at all. The matter is that Shinde faction is Shiv Sena and it is the opposition faction in the party which has majority of the members. Only the Election Commission could have taken this decision.” Who is the real party. Now the Election Commission has said that the Shinde faction is the official Shiv Sena.

Supreme Court: Justice Hima Kohli said, “On June 30, there was only one party. You contested on the basis of the ticket you got from the original party. If you say you are the original party, you should have done it outside the assembly, in the House.” No.’

Shinde faction: NK Kaul said, “The floor test was to show that the Thackeray group has lost the majority. We are the group which represents the real Shiv Sena in case of internal differences. As far as the floor test is concerned, it is only because Whether the Chief Minister has a majority or not, the Election Commission had to decide and it has decided.
