The Court of Judicial Magistrate Nidhi Saini, Kharar, made important remarks while granting bail to the arrested Rankaj Verma in the case related to viral videos of girls taking bath in Girls Hostel of Chandigarh University (CU). The court said that the liberty of a person cannot be taken away on the basis of mere conjecture and suspicion. Rankaj Verma, 31, is a resident of Shimla and was arrested on September 18.
After hearing Rankaj’s regular bail petition, the court said that it would take a long time to present the challan and trial the case. In such a situation, no purpose is served by keeping the accused (Rankaj) in jail for an indefinite period.
The court granted bail to Rankaj after his lawyer argued that his client’s photo had been misused.
The court has said in its judgment that on September 17, 2022, a very strange and shameful incident took place in the Chandigarh University campus. In which a university student was found allegedly making objectionable videos of other girl students. After this incident, the students demonstrated.
The conversation with the girl of Rankaj did not come to the fore
The court said that the incident which has been told by the prosecution is condemnable. However, looking at the investigation of the case so far, the court found that the accused student, who was caught making an allegedly objectionable video, was getting calls from a number. The number from where the calls were coming had a picture of Rankaj Verma. Although this mobile was being used by someone else instead of Rankaj.
If acquitted, I will file a case against Punjab Police.
No conversation surfaced with the accused girl of Rankaj. After the matter came to light and his photo went viral on social media, Rankaj Verma himself surrendered to the police. Prima facie his involvement is on the basis of Display Picture (DP) installed in the mobile which was taken from social media. No other role of his has come to the fore in the investigation so far. He is in her custody since 18 September.
Rankaj was granted bail by the court on the basis of a personal bond of Rs 1 lakh and a local surety. After completing the paper formalities on Saturday, Rankaj Verma came out of Ropar Jail.
Rankaj runs a travel company in Shimla. Rankaj said that if he is acquitted in the case, he will file a case of malicious prosecution and defamation against the Punjab Police.
Rankaj got bail on these conditions
- He will have to appear at every hearing of the case.
- shall not, directly or indirectly, coerce, threaten or promise any person connected with this case. That will not stop them from presenting facts related to the case before the police or the court. Will not tamper with the evidence of the case.
- He cannot leave the country without the approval of the court.
Got stuck because of good looking photo
Rankaj Verma’s counsel during the hearing of the bail plea in Kharar Court said that the FIR was registered on the basis of the facts which stated that the accused student was making videos in the washroom of other girls. He was caught by the warden and a complaint was given to the police. The girl student was getting a WhatsApp call from a mobile number and the caller was sending objectionable videos on the girl’s mobile. He was demanding videos of girls from the accused student. The WhatsApp caller had put a picture of Rankaj on his Display Picture (DP).
The lawyer said that in this case his photo went viral, then Rankaj saw him on TV channel and surrendered at Dhali police station in Shimla. Rankaj had said that he had no role in the case, but still he was ready to join the investigation. After this the Punjab Police arrested him.
Rankaj has been saying from day one that his photo was misused. He is facing all this because of his good looking picture.
Fauji Sanjeev Singh used to chat with his photo
On September 18, the police also caught Sunny Mehta, a resident of Rohru in Shimla, who was said to be the old boyfriend of the accused student. Sunny had a fight with the accused student. After this, on 24 September, Fauji Sanjeev Singh was arrested from Arunachal Pradesh. Sanjeev Singh put the photo of Rankaj on the DP of his WhatsApp number and started chatting with the accused student. The soldier himself asked the accused student for a video of the university girls taking a bath.
According to the accused student, Fauji Sanjeev, originally from Jammu, was blackmailing her. The Kharar police initially registered a case under section 354C of IPC and section 66E of IT Act. Both these are bailable clauses. Later, Section 67A of the IT Act was also added, which is non-bailable and imprisonment up to five years is possible. The case was registered on the complaint of Chandigarh University official Ritu Ranaut.
