The Supreme Court Collegium has taken a major step amid the tussle between the Center and the judiciary over the appointment of judges. The Supreme Court on Thursday issued three letters on its website rebutting the objections raised by the Center and RAW-IB on the promotion of advocates Saurabh Kripal, Somashekhar Sundaresan and R John Sathyan. Along with this, SC also answered the objections of the Center on the issue.

The Supreme Court called the decision of the Center not to approve the appointment of all three lawyers as judges wrong. The court said that criticism of government schemes is not a ground to stop the promotion of a lawyer. In response to the objection of the Center on the name of advocate Saurabh Kripal in the Delhi High Court, he said that the proposal for the appointment of Kripal as a judge is pending for more than 5 years. Now this process should be completed as soon as possible.

Why does the government object to the names of the lawyers?
In fact, the Center had told the reason for objecting to the name of Sundaresan was to criticize the policies of the government. The Center said that they express their stand on many issues. At the same time, the Center had objections regarding Satyen’s two WhatsApp message forwards. At the same time, referring to the objections of RAW regarding Kripal’s foreign gay partner, he refused to approve his name.

After this, before issuing the letter on Thursday also, they discussed again. It has been decided in the meeting that the Supreme Court collegium will again send its recommendation for elevation of advocates Saurabh Kripal, Somashekar Sundaresan and R John Sathyan to the Centre.

For long, the SC collegium has been accusing the central government of delay in clearing the names of judges sent for appointment. On January 16, Law Minister Kiren Rijiju wrote a letter to the CJI asking him to include his representative in the collegium. To respond to the Centre’s stand, the Collegium headed by the CJI decided that this time the entire matter should be made public.

The Center returned the name of Bombay High Court lawyer Sundaresan for criticizing the policies of the central government. The collegium re-recommended Sundaresan’s name, saying he has expertise in commercial law. He can prove to be an asset for the High Court. The Collegium had sent Sundaresan’s name to the Center on February 16, 2022.
