Former Jharkhand minister and MLA from Ranchi’s Mandar Bandhu Tirkey has been found guilty in the disproportionate assets case. On Monday, the court of Special CBI Judge PK Sharma sentenced him to 3 years imprisonment. Along with this, a fine of Rs 3 lakh has also been imposed. Failure to pay the fine will result in an additional imprisonment of 6 months. However, Bandhu Tirkey can get bail from the court today. The paperwork is going on.
After the sentence, his legislature has also been in danger. As per the law, the MLA’s membership terminates on sentence of more than 2 years.
Tirkey, the working state president of Jharkhand Congress, is accused of earning Rs.6,28,698 more than the income. The CBI had registered an FIR against Tirkey on August 11, 2010 for acquiring disproportionate assets in the Koda case. He was arrested on 12 December 2018 from his residence in Banahura. He was granted bail by the High Court after spending about 40 days in jail.
The allegation was formed in January 2019
The charge was framed on 16 January 2019. In this case, 21 testimonies including CBI SP and investigating officer of the case PK Panigrahi and then DC of Ranchi, Rajiv Arun Ekka have been recorded. Whereas, five testimonies were made on behalf of the defense. Let us tell you, after the strictness of the CBI court, from 24 February 2019 to 16 March 2019, there was continuous debate on behalf of the defense in the case. The debate was pending for the last two years.
The closure report was quashed by the court
CBI Delhi investigated the case of Bandhu Tirkey and filed closure report in May 2013. It said that disproportionate assets have been found in Tirkey’s possession, but the assets are so small that it is not in favor of prosecuting him in the matter. After reviewing the closure report, the Special Judge of CBI had declared this side as invalid. He had said, “The accused has 30 per cent more money than the income. Which is worth running trial.
