The Supreme Court is set to convene on Monday to deliberate on a petition filed by Congress leader Pawan Khera challenging the refusal of the Allahabad High Court to dismiss criminal proceedings against him. These proceedings are in connection with alleged objectionable remarks made against Prime Minister Narendra Modi, PTI reported.

A bench comprising Justices BR Gavai and Prashant Kumar Mishra will be presiding over the hearing. It is worth noting that this matter was previously listed on October 13, but the proceedings were postponed at the request of Khera’s legal representative, who sought additional time to submit supplementary documents.

On August 17, the high court, in its verdict, dismissed Khera’s plea, asserting that the evidence collected by the investigating officer of the case cannot be evaluated through a petition filed under section 482 of the CrPC for quashing the case. The high court further pointed out that, in accordance with a prior directive from the Supreme Court, Khera should address all his contentions before the chief judicial magistrate in Lucknow.

Earlier this year, on March 20, the Supreme Court amalgamated three FIRs filed against Khera in Assam and Uttar Pradesh due to his alleged objectionable remarks against Prime Minister Modi. The Supreme Court subsequently transferred the case to the Hazratganj police station in Lucknow while granting Khera interim bail. The Lucknow court later granted bail to Khera. It’s important to note that Khera has tendered an unconditional apology in the court regarding the alleged remarks.

In another significant legal development, the Supreme Court is scheduled to hear a plea on Monday lodged by Aam Aadmi Party (AAP) leader Raghav Chadha. He is challenging his indefinite suspension from the Rajya Sabha, PTI reported.

The bench for this case consists of Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra. The suspension was imposed on Chadha on the final day of the Monsoon Session of Parliament, August 11. This decision was made on grounds of gross rule violation, misconduct, a defiant attitude, and contemptuous conduct, pending a report by the privileges committee.

The theme for this year’s community Puja revolves around the Ram Mandir in Ayodhya.
