The incident took place at Hardiya Koeri Tola village under Muffasil police station of West Champaran district.
Contacted over phone, West Champaran SP Upendra Nath Verma told TOI on Monday that the minister’s brother Harendra Prasad and his nephew Vijay Sah have also been named in the FIR lodged by Rina Devi, mother of one of the injured children.
Verma said a total of seven persons including Bablu, have been named as accused in the FIR. The complainant has alleged that Bablu and his supporters reached the village orchard and asked the children playing cricket there to vacate the private orchard. As children resisted they beat up some of them. It has also been alleged that Bablu allegedly opened fire in the air to scare away the children.
The SP said police have also seized the vehicle used by the minister’s son to reach the village orchard. Bablu’s licensed rifle and licensed pistol which he carried to the orchard, have also been seized for further investigation. He said the FIR has been registered with Muffasil police station under Sections 147, 148, 149, 323, 307 of the IPC and 27 of the Arms Act.
Verma said as contradictory claims were being made by people about the opening of fire in the air, the Sadar SDPO Mukul Parimal Pandey has been asked to investigate the matter. He said police were also verifying the video footage of the incident.
Soon after the incident on Sunday, a team of police from Mufassil police station reached the village and seized the vehicle used by Bablu to reach the orchard. A group of villagers then told police that the trouble broke out when Bablu went to ask the children who were playing cricket there to clear his orchard.
Bablu told police that he and his men went to the village upon learning about an attempt of “land encroachment” in the orchard. He said they were assaulted and robbed of the licensed rifle by the villagers. His vehicle also was vandalized by the villagers.
The minister Narayan Prasad, however, accused the villagers of trying to encroach his land in the orchard. He said that villagers first attacked his younger brother who had gone to the village to oppose encroachment on his land by the locals. “A few of other members of my family were also thrashed,” Prasad, the BJP MLA from Nautan, said.
“After my family members were beaten up by the villagers, my son went to the spot with his licensed rifle and pistol but he was also attacked with stones. The villagers also vandalized his vehicle,” the ministers said.
