All three convicts of Chhawla gangrape case in Delhi acquitted: Supreme Court overturns High Court’s decision, HC had given death sentence

The Supreme Court has acquitted the convicts of gang-raping a 19-year-old girl in Delhi’s Chhawla in 2012. In 2014, the trial court and the Delhi High Court had sentenced the accused Ravi Kumar, Rahul and Vinod to death in this case. On Monday, a bench of CJI UU Lalit in the Supreme Court overturned this decision.

The girl from Uttarakhand was kidnapped by the accused while returning from her job on the night of 9 February 2012. She was gang-raped in Chhawla. The accused took him out of Delhi by putting him in the car. During the gang rape, the girl was also raped. His body was lit with cigarettes and acid was poured on his face. His body was attacked with car tools and many other things. After the gangrape, the accused killed her. On February 14, the girl’s body was found in Rewari, Haryana.

The decision of the lower court was upheld by the High Court.
In this case, the accused named Rahul, Ravi and Vinod were arrested by the Delhi Police. In this case, the lower court of Delhi had sentenced the three accused to death in the year 2014, terming it as the rarest case. On 26 August 2014, the High Court also upheld the death sentence, upholding this decision.

Supreme Court had said – decisions are not given on the basis of feelings
During the hearing in the Supreme Court on 7 April, the judges had said that the punishment cannot be imposed on the basis of feelings. In fact, during the hearing of the case, the father of the victim girl had said that the culprits of the case should be given capital punishment. On this, the judges had said that punishment is given on the basis of logic and evidence. We are understanding your feelings, but decisions are not taken in the court by looking at the feelings.
