The Consumer Forum has imposed a fine of 50 thousand on Soma, a company running toll plazas in Punjab. This fine came on the complaint of a Ludhiana woman. Due to the pothole on the road, the tires of his car got damaged. After which he filed a case in the Consumer Forum of Ludhiana. He said that after paying toll tax, he is also a consumer. This argument was accepted by the Forum. However, for this he had to fight for about 6 years.
Car tires damaged while coming from Ambala
Advocate Hari Om Jindal of Ludhiana told that in 2016 Samita Jindal of Kitchlu Nagar was coming back to Ludhiana from Ambala in her car. As soon as he reached near Khanna, the tires of his car got damaged due to pothole on the road there. They were inconvenienced due to potholes all along the way. After this he filed a complaint in the consumer forum. Which lasted about 6 years.
Consumer Forum acknowledged the consumer
Advocate Hari Om Jindal said that when this case came to him, he filed a case in the consumer court. When the tire of Samita Jindal’s car burst, she traveled from Ambala to Ludhiana in an atmosphere of fear. He argued in the forum that when we pay toll tax, we come under the category of consumer. People pay toll fee because they get good roads but in this case it did not happen. He also submitted toll receipts as proof. Which the forum accepted.
People can complain in consumer forum
Advocate Hari Om Jindal said that due to this decision, people paying toll have now come under the category of consumer. If there is any inconvenience even after paying the toll, then they can approach the forum. This will end the arbitrariness of toll companies.
