States ought to collect quantifiable data before granting reservation in promotion to SC/ST employees: SC | India News – Times of India

NEW DELHI: The Supreme Court on Friday said that states are obliged to collect quantifiable data on the inadequacy of representation for SCs and STs employees in government jobs before implementing reservations for them in the promotion. The court further said that it cannot lay down new yardstick after Constitution bench decisions.
The top court gave broad parameters on the reservation in promotions for SCs and STs employees. It will decide the validity of the Centre and various state govt policies for reservation in promotion on those parameters.
The SC refrains from adjudicating on quantifying inadequacy of representation for reservation in promotion and says that it is for the govt to take a call.
Meanwhile, the court said it will take a call whether the office memorandum issued by the Centre in 1997 for reservation in promotion is valid or not.
The Delhi high court had quashed it in 2017 and since then there has been no reservation in promotion in central services.
