The Madras High Court has allowed Vasami Sudarshini of Tamil Nadu to marry an American boy on virtual mode. Actually, Wasmi had filed a petition in the High Court. In this, she said that she wants to marry NRI Rahul L Madhu, who lives in the US and has citizenship there.

Registered to get married under the Special Marriage Act
He said that our parents have agreed to the marriage. We both follow Hinduism and are eligible to get married under the Special Marriage Act. Online application was also done to get married under this act. After this both of us personally appeared before the marriage registrar. But as per the terms and conditions, they waited 30 days to decide the marriage. Even after waiting, the registrar did not take any action on the marriage application.

Wasmi said that even after appealing for the marriage, there was delay. Meanwhile, Rahul’s leave was over, so he had to go to America. But Rahul has given an affidavit, in which he will be ready for any process related to registration of marriage.

Due to these circumstances, he appealed in the petition that he should get married through video conferencing and it should be registered through the Special Marriage Act.

Instructions for getting married in the presence of three witnesses
Hearing the matter, Justice GR Swaminathan of the Madurai Bench directed the sub-registrar to conduct the marriage in the presence of three witnesses. At the same time, it said that if the petitioner has a power of attorney on behalf of Rahul, then she can put her signature in the marriage certificate book on behalf of Rahul after marriage.

The marriage certificate is issued by the sub-registrar under section 13 of the Act.
