Hijab will not be allowed in schools and colleges in Karnataka. The Karnataka High Court gave this decision on Tuesday. In the decision regarding the ongoing tussle on this matter for the last 74 days, the High Court said two important things. First- Hijab is not a mandatory part of Islam. Second- Students cannot refuse to wear the prescribed uniform of school or college.

The High Court dismissed all the 8 petitions made by other people including Muslim girls in support of Hijab. Chief Justice Rituraj Awasthi, Justice Krishna S. Dixit and Justice Khaji Jayabunnesa Mohiuddin also refused to set aside the February 5 order of the state government, which had made school uniforms mandatory.

These two things became the basis of the decision
Before delivering the verdict on Tuesday, Chief Justice of the High Court Rituraj Awasthi said that it is important to consider two questions in this matter. First- Does wearing hijab come under the right of religious freedom under Article 25. Second- Is asking to wear school uniforms is a violation of this freedom. Subsequently, the High Court upheld the ban on hijab in educational institutions.

Security was beefed up outside the residence of Chief Justice Rituraj Awasthi ahead of the Karnataka High Court’s decision on the hijab controversy. All types of processions and gatherings were banned by imposing Section 144 in five districts of Karnataka including the capital Bengaluru. The Karnataka High Court heard the matter continuously for 11 days. During the hearing, the counsel for the petitioner had said that in Islam, girls have been asked to keep their heads covered. In such a situation, the dress code banning hijab in schools and colleges is completely wrong.

Against this, the state’s Advocate General (AG) Prabhuling Navadgi, appearing for the Karnataka government, argued before the bench that hijab was not a compulsory religious practice of Islam. Therefore, unlike the uniform, hijab should not be allowed in schools and colleges.

Court had asked for a copy of the Quran
The Bench of the Karnataka High Court, during the hearing of the case, had sought a copy of the Holy Quran from the petitioner to substantiate the argument made by him. Justice Dixit had asked during this – is this an authentic copy of the Quran, there is no dispute if it is authentic. On this the Advocate General had said that there are many translations of the Quran.

The hijab controversy started on January 1
The controversy over the hijab in Karnataka started on January 1. Here in Udupi, 6 Muslim girl students were barred from sitting in a class room in the college for wearing hijab. The college management had cited the new uniform policy as the reason.

After this these girls filed a petition in the Karnataka High Court. The girls argue that not allowing them to wear the hijab is a violation of their fundamental right under Articles 14 and 25 of the Constitution.

28 Muslim girl students of Kundapura College in Karnataka were stopped from attending class wearing hijab. Regarding the matter, the girls had filed a petition in the High Court saying that hijab is mandatory in Islam, so they should be allowed it.
