Case-1: Teacher beat in front of everyone, student committed suicide

On 2 December 2022, Kavin Kumar, a 16-year-old student studying in a private school in Chennai, committed suicide. The day before, the physical education teacher had beaten him in front of all the students in the school. Kavin’s younger brother studying in the same school was also beaten up two days before the incident. After Kavin’s death, the police registered a case.

Case-2: Student made half-dead for not wearing school uniform

On 3 December 2022, a student in a school in Hardoi went to school without wearing a uniform. The PTI teacher mercilessly thrashed him without knowing the reason, leaving the entire class in panic.

Case-3: Girl student wrote ‘boring class’ on social media, teacher beat her

On November 29, a girl student in Telangana posted on social media writing ‘boring class’. Enraged by this, the teacher thrashed the girl with a stick in front of the entire class. When the video of the beating went viral, the police registered a case.

Case-4: The principal brutally killed the students on suspicion of breaking the tap

The bathroom tap broke in a government school in Una, Himachal Pradesh. The principal mercilessly thrashed 2 students on the basis of suspicion on 1st December. The condition of one student deteriorated so much that he had to be admitted to the hospital. After complaining to the police, the education department started an investigation against the principal.

Case-5: Child was talking in lunch, fractured spine due to beating

On November 23, a teacher in a government school in Rajasthan thrashed a student so mercilessly that the child suffered a spinal fracture. This incident is of Tonk district where the child was busy talking during lunch, due to which the angry teacher made him fall down by holding his neck and then beat him by foot on his neck. The child fainted. After the matter escalated, the teacher was suspended and a case was registered against him.

Such cases often come to the fore in the country, in which teachers get angry on trivial matters and children have to lose their lives or suffer serious injuries. Psychiatrist Dr. Avni Tiwari says that corporal punishment has a bad effect on children. They not only suffer physical injuries due to beatings, they also suffer trauma and emotional pain. He feels humiliated for being beaten up in front of others. It has a bad effect on their mind.

‘The atmosphere of every country and place is different, America’s punishment can be fun here’

Director of Drishti IAS Coaching Center Divya Kirti says in an interview given to India Today Group that nowadays teachers do not even give the kind of punishment to children that they used to give in our times. In our times, when teachers used to give corporal punishment, their aim was to teach the children.

He further says that in America, children are made to sit in the staff room for 1 hour in the name of punishment or are asked to stand facing the wall for 1 hour. No one talks to the child in that 1 hour. There it is punishment. The environment of India is different. If the children get such punishment here, they would call it ‘fun’. This is probably the difference of the environment, according to which the teachers make a way to explain or discipline the children.

‘Family members or teachers do not kill to remove enmity’

In an interview, ‘Khan Sir’, who conducts UPSC preparation in Patna and director of GS Research Center, says in his familiar funny style that parents and teachers do not beat students to remove enmity. Their aim is to make the students understand and many times through one student the message is given to the rest of the students to remain disciplined. On the question of parents complaining, ‘Khan Sir’ says that he even tells the parents that if you had kept the children in discipline, we would not have had to take such a step.

Children will be disciplined like this, there will be no need to beat

Psychiatrist Dr. Avni Tiwari tells that there are many better ways to discipline children, by which they can be made responsible and good human beings. If children do something good, praise them. There is a lot of lack of praise to children in our society, so if you praise children, then they will do good work in future and their behavior will also be good.

From time to time, children can be motivated to remain disciplined even by giving them small prizes like toffee, chocolate. If they get an award for discipline, they will quickly learn its importance.

Even after this, if children make a mistake, instead of beating them, ask them to sit back and think about their mistake, but during this time do not treat them badly or humiliatingly. This will make them realize their mistakes.

Teaching cycling and teaching discipline are same

Sociologist Dipendra Mohan Singh says, suppose a child has to be taught to ride a bicycle. In such a situation, he will not learn to ride a bicycle just by giving him bookish knowledge about the bicycle. For this you have to prepare him for cycling. If the child learns to hold the cycle and maintain balance, he will fall and get hurt. Only then will he learn to ride a bicycle.

Similarly, it is important for the child to participate in the first discipline. During this he can also break discipline. Punishing him for failure during this training process would disturb his learning process. It is only by showing patience here that he will learn the ABCD of discipline.

The law protects children from violence. For this, provisions have been made in acts like JJ Act and RTE.

Punishment is given in Juvenile Act 2015 and RTE 2011

There were many such provisions in ‘Delhi School of Education Rules 1973’ in which physical punishment could be given to children to maintain discipline, but in ‘Delhi Right to Education Rules 2011’ it was provided that no child should be subjected to physical punishment. should not be given. Due to this he also has to go through mental harassment. If someone gives corporal punishment then he can be punished under Juvenile Act 2015 and RTE 2011.

There are also provisions for punishment

Pancham Jha, a lawyer practicing in the Delhi High Court, says that there is a provision of punishment under the Juvenile Justice Act (JJ Act) and RTE for intentionally beating a child with a wrong intention.

If the child is given physical punishment or mental torture, then section 17(1) of RTE prohibits it and in its section 17(2) provision for punishment has been made.

It has been said in this that no child can be given physical or mental torture. There is a provision of fine and punishment for violating it.

If the child does something, he will not be punished by law.

According to Advocate Pancham Jha in the Delhi High Court, in the judicial system, childhood is considered to be naive and incapable of understanding. That’s why no criminal cases are filed against children below the age of 7 years. That is, it is not legal to give both physical and mental punishment to children below the age of 7 years. Not only this, in Section 83 of the IPC, even children between the age of 7 to 12 years are not considered to be the subject of physical punishment, considering them to be of immature understanding.

JJ Act protects children from beating or child battery even at home

Child battery is one of the more serious forms of domestic violence. To prevent this in homes and schools, provisions have been made in the ‘Juvenile Justice Act 2000’ which were not there in the 1986 Act. In America and Europe, when a child is usually beaten by a parent or a family member, it is counted in the category of ‘child battery’. Sometimes it also includes sexual abuse with children.

Teacher gets away with a law after beating or causing pain to a child

However, Section 88 of the IPC gives some protection to both the teacher and the doctor. This section states that it is not an offense if a person, in good faith, scolds, reprimands or beats another person, without any intention of killing, and the victim consents to it in some form or the other.

In such a case even section 323 will not apply. It has been said in this section that if someone willfully causes injury or damage to any person, he shall be punished with imprisonment of either description for a term which may extend to one year, or with fine which may extend to one thousand rupees, or with both.

Corporal Punishment Status Abroad

Sweden was the first to ban all forms of corporal punishment of children in 1979, while other European countries such as Denmark, Norway, Finland, Austria, Cyprus, Italy, Croatia and Latvia have no corporal punishment laws. There is a strong movement against corporal punishment in schools in Germany, Switzerland, Poland, Spain, Canada, New Zealand, Mexico, Namibia, South Africa, Sri Lanka, Jamaica, the Republic of Ireland, Belgium, Korea and the United Kingdom.

Most northern states in the US have strict laws against corporal punishment. These states include California, Michigan, Lava, New Jersey, Alaska, Washington, West Virginia. Although corporal punishment is legal in some states, there are many protections given to children.

No strict law in Nepal and Bangladesh

Nepal Section 7 of the Children’s Act 1992 declares, ‘No child shall be treated with cruelty’ but it also states that if the child’s parent or any member of the family scolds or lightly So considering it in the interest of the child, it will not be considered a violation of the law.

Bangladesh The Children Act 1974 criminalized cruelty to children, which includes parents and guardians and teachers.

Overall, the attitude of teaching children has changed in the country and the world. The interference of technology in studies has also destroyed the importance of corporal punishment.

In such a situation, for discipline, teachers and parents have to change their attitude and make a little effort to understand the children in the changing environment.
