Diabetic prisoner gets bail after 2 days of death: Leg amputated after gangrene, had lung infection too; The Mumbai Sessions Court did not know

The Mumbai Sessions Court granted temporary bail to the accused for 6 months.

A Mumbai court granted temporary bail to an accused named Suresh Pawar, but two days after his death. Actually the matter is of May 11. The court was unaware that the accused had died on May 9. Even the 9 page order granting temporary bail on medical grounds did not mention that the accused is dead.

It was said in the bail petition – I am a patient of diabetes
Accused Suresh was booked by the Mumbai Police in 2021 for cheating and forgery. He was arrested on 31st December 2021 and since then he was behind the bars. Hearing on the case was going on after the charge sheet was filed.

Suresh had told the court in his bail plea that he was suffering from severe diabetes and age-related ailments.

Had to amputate leg due to gangrene
In February 2023, Suresh suffered a toe injury. After this he was admitted to JJ Hospital. A few days later he was discharged but his toe developed gangrene and had to be amputated. It was also told to the court that due to wrong treatment in April, his wound had become septic, due to which his leg had to be amputated below the knee. Not only this, there was an infection in his lungs as well.

Bail petition filed on 4th May, died on 9th May
Suresh’s lawyer filed a medical bail petition on May 4, seeking to transfer him to a private hospital for proper treatment. The court heard all the parties on May 8 and reserved the order till May 9.

Thereafter, the complainant filed an intervention petition on 9th May. Due to which the decision on Suresh’s bail was postponed till May 10.

On May 10, the court was busy hearing other matters and getting orders written. Due to this the decision was adjourned till May 11.

On May 11, the accused was granted temporary medical bail for 6 months on medical and humanitarian grounds but with several conditions.
