According to the news of India Today, in her statement to the police, the victim said that her 43-year-old father sexually assaulted her for the first time in January 2019. When he saw her sleeping alone. Her brother (20 years) also molested her later that month.

Told her ordeal to the teacher for fear of sexual abuse with her younger sister

The victim told that she was afraid that her father and brother would sexually abuse her younger sister too, which is why she decided to narrate her ordeal to her teacher. Based on the complaint of the girl, a case was registered under the Indian Penal Code and the relevant section of the POCSO Act. His father and brother were taken into custody. During rigorous interrogation, the accused admitted their crime, after which they were arrested.

What is POCSO Act?

The full name of POCSO Act is ‘The Protection Of Children From Sexual Offenses Act’ or Protection of Children from Sexual Offenses Act. In Hindi it is called ‘Protection of Children from Sexual Harassment Act 2012’. POCSO Act-2012; It was created by the Ministry of Women and Child Development, to prevent heinous crimes like sexual harassment and sexual abuse and pornography against children. Under this law made in the year 2012, different punishments have been fixed for different offenses.

Changes have been made in the ‘PACSO Act-2012’ to stop the increasing violence against girls in the country, under which the culprits of raping a girl child up to 12 years of age will be given death penalty. Under this act, strict action is taken in cases of sexual offenses and molestation with minor children. At the same time, according to section 35 of the Act, if there is no special circumstance, then its case has to be disposed of in one year.
