CJI: Trust Indian judiciary for absolute independence | India News – Times of India

NEW DELHI: Responding to oft-expressed apprehensions about judiciary’s autonomy, Chief Justice of India N V Ramana on Saturday declared from an international meet that Indian judiciary treats all equally and equitably and the world business community must trust its absolute independence.
Delivering the inaugural address at International Conference on ‘Arbitration in the Era of Globalisation‘ in Dubai, Justice Ramana said, “Wherever I travel, I am often asked as to how investor-friendly the Indian judicial system is?”
“My answer is always the same: you can trust the Indian judiciary for its absolute independence and its inherent constitutional strength to treat all parties equally and equitably. A prerequisite for achieving globalisation in its true sense is ensuring universal respect for the rule of law,” he said.
He said the rule of law and arbitration were not in conflict. “Both arbitration and judicial adjudication aim to serve the same goal – pursuit of justice. The Indian courts are known for their pro-arbitration stance. Courts in India assist and support arbitration, and leave the substantive part of adjudication to the Arbitral Tribunal itself,” the CJI said.
He said one of the surest ways to attract foreign investment is to make available a stable and efficacious mechanism for redressal of disputes. “The legislature, executive and judiciary of India at all levels, are committed to improving the arbitration landscape and the ease of doing business. The Commercial Courts Act led to further streamlining and speedy dispensation of justice in commercial matters,” he said.
However, he said: “Having a pro-arbitration jurisprudence and policy is not enough. Some innovative steps must be taken,” he said. The Dubai conference would have sessions chaired by Justices D Y Chandrachud, L N Rai and Hima Kohli as well as UAE’s Justice Shamlan Al Sawalehi. The CJI mooted a 14-point prerequisites to make arbitration effective and successful.
