Brijbhushan gets regular bail with conditions: will not be able to leave the country without permission, instructions not to influence witnesses

Former WFI President Brij Bhushan Sharan Singh arrives at Delhi’s Rouse Avenue Court.

Delhi’s Rouse Avenue Court has granted regular bail to former Wrestling Federation of India (WFI) president and BJP MP Brij Bhushan Sharan Singh. The court also granted regular bail to Vinod Tomar Singh, assistant secretary of the Wrestling Federation. The court granted bail to both of them on a personal bond of Rs 25,000 each. The next date of hearing for scrutiny of documents has been fixed for July 28. A case of sexual exploitation of 6 adult female wrestlers is going on against Brijbhushan. In this case, the police has presented the charge sheet.

While granting bail to Brij Bhushan, the court imposed several conditions. The court said that the accused shall not directly or indirectly influence the complainants or the witnesses. Will not leave the country without the permission of the court.

During the hearing, the counsel for the victims objected to the grant of bail. He said that MPs are politically powerful and have the ability to influence witnesses, so they should not be granted bail.

Advocate Rajeev Mohan, appearing for Brij Bhushan Sharan Singh, cited old decisions of the Supreme Court and said that in cases where the police have not arrested the accused, the accused is entitled to seek bail from the court. Brij Bhushan was also present in the court.

Earlier, the Delhi Police told the court that it was neither opposing nor supporting bail.

On July 18, the court granted interim bail for two days to Brij Bhushan and Union Secretary Vinod Tomar.

In the hearing on the day of interim bail, Brij Bhushan’s lawyers had argued that the Delhi Police had filed the charge sheet without investigation. There is no provision of punishment for more than 5 years in these cases. When the court asked about the bail, the Delhi Police had said that Brij Bhushan has not been arrested, but there should be a condition of bail. On which the court granted interim bail instead of regular.

5 important things about wrestlers sexual abuse case on Brij Bhushan

1. Delhi Police said in the charge sheet – no need for arrest
Delhi Police had said in the charge sheet presented in the court that there was no need to arrest Brij Bhushan. Brij Bhushan followed the instructions of the police and joined the investigation. The Delhi Police also cited the Supreme Court’s judgment that there is no need to immediately arrest the accused in cases punishable with imprisonment up to 7 years.

2. Only 15 witnesses supported the allegations
Delhi Police recorded the testimony of 108 people. Of these, only 15 witnesses supported the allegations of the wrestlers. WFI staff-office assistant, office staff and office boy did not corroborate the statements of the wrestlers. 93 witnesses did not corroborate the allegations of the wrestlers.

3. Forensic report not received
Delhi Police has said in its charge sheet that the report of digital and electronic evidence deposited in the forensic lab has not come. After the report comes, they will be filed as a supplementary charge sheet.

4. Nothing objectionable found in call data record
Police have not found anything objectionable so far on checking the call data records. Despite repeated requests from the police, no evidence was provided by the wrestlers regarding the ‘threat call’. However, its complete report is also being said to come.

5. Brijbhushan said – never met wrestlers alone
According to Delhi Police’s charge sheet, Brij Bhushan made a statement that he never met wrestlers alone. Brij Bhushan was seen with the wrestlers in some photos. However, Brij Bhushan said that if that were the case, he would be standing with the wrestlers in every photo, but that is not the case.
