Jharkhand Chief Minister Hemant Soren got a big relief from the Supreme Court on Monday. The ongoing lease allotment case in the Jharkhand High Court has been considered not maintainable by the Supreme Court. In this case, the Jharkhand High Court had considered the petition related to allotment of lease and investment in the shell company by his close friends, which was challenged by the government and the CM.

A bench of Chief Justice UU Lalit, Justice Ravindra Bhatt and Justice Sudhanshu Dhulia, while delivering the verdict, said that the case registered in the Jharkhand High Court is not maintainable. On August 17, the Supreme Court had reserved the verdict after completing the hearing on the appeal petition of Hemant Soren and the state government.

What’s the matter?
A PIL was filed in the Jharkhand High Court on behalf of Shiv Shankar Sharma against Chief Minister Hemant Soren alleging wrongful allocation of mining leases and investments in shell companies by his close associates. During the hearing in the High Court in this matter, Jharkhand Government and Hemant Soren said that the petition is not maintainable.

However, the court considered it maintainable. In this case, the government appealed to the Supreme Court. After hearing in the matter, the Supreme Court had reserved the decision on August 17 after the hearing on the appeal petition of Hemant Soren and the state government by a bench headed by Chief Justice U U Lalit.

Soren had said that during that time I was not holding any office of profit.

In this matter, on February 10, a complaint was also made to Governor Ramesh Bais by former CM Raghuvar Das. There was a demand to cancel the assembly membership of Chief Minister Hemant Soren. The Governor had sought the opinion of the Election Commission on this. The commission gave its opinion in a closed envelope. The Governor has not taken any decision on this yet. How to relieve Hemant? Hemant Sarkar is surrounded all-round in the Office of Profit case. The Governor has sent a letter to the Election Commission for the second time seeking advice. In such a situation, considering the matter not worthy of hearing on behalf of the Supreme Court is a big relief for the government.

In this letter, a demand has been made to provide a copy of the second opinion letter sought from the Election Commission.

As such, the case of abuse of office of profit does not arise and they cannot be disqualified.
