Ashok Kumar Gupta, PCME/CR is a highly corrupt officer and demands bribe from contractors as well as their employees – writes CBI in FIR – Rail Hunt

Suspected Offence: Criminal Conspiracy, obtaining undue advantage by public servant by abusing his official position as public servant / corrupt or illegal means, bribing a public servant by a commercial organisation

As per the FIR registered by the CBI, Information received from reliable source reveals that Ashok Kumar Gupta, (IRSME-1985 batch) presently posted as Principal Chief Mechanical Engineer (PCME), Central Railway, Chhatrapati Shivaji Maharaj Terminus (CSMT), Mumbai since 2020 and residing at House No. 25, 5th Floor, H Block, Badhwar Park, Pool Wood House Road, Colaba, Mumbai – 400005 is a highly corrupt officer and demands/obtains bribe amount from contractors as well as their employees.

Ashok Kumar Gupta while posted and functioning as PCME, Central Railway, CSMT, Mumbai is indulging in corrupt practices in collusion with Aditya Tibrewal, partner of M/s. Anand Sales Corporation having office at 9th Floor, B Block, 113, Park Street, Poddar Point, Kolkata-700016 and other unknown public servants/unknown persons in the matter of award/execution of Tenders and clearing of due bills of M/s. Anand Sales Corporation in respect of Mechanical Division of Central Railway, Mumbai. The Mechanical Division of Central Railway, Mumbai is headed by Ashok Kumar Gupta, as the Principal Chief Mechanical Engineer from January 2020 till date.

Being in-charge of Mechanical Division of Central Railway, Mumbai, Ashok Kumar Gupta is overall responsible for the work of the Mechanical Division of Central Railway. He is handling approval of work orders, supply of materials, finalization of tenders, inspection of materials, passing of bills of vendors, etc.

Information also revealed that all Tenders and Work Contracts related to Mechanical Department of Central Railway comes under the purview of Ashok Kumar Gupta. He is in the habit of demanding bribe by abusing his official position for smooth functioning of contract work and passing of bills under his jurisdiction.

He collects from his subordinate of each section information related to total bills passed for each contractor and accordingly he threatens and forces contractors in order to collect bribe money from them.

Information further revealed that Ashok Kumar Gupta, PCME has entered into a criminal conspiracy with M/s. Anand Sales Corporation, Kolkata through it’s Partner/employee namely Aditya Tibrewal and some unknown public servants and private persons in order to help M/s. Anand Sales Corporation, Kolkata in payment of pending bills of the said firm in Central Railway and in lieu of the same, has demanded bribe from Aditya Tibrewal of the above said firm and in furtherance of the said criminal conspiracy Aditya Tibrewal has agreed to pay him a bribe.

Information further revealed that for this purpose, Aditya Tibrewal is in regular contact with Ashok Kumar Gupta for delivery of the bribe amount to Ashok Kumar Gupta. Aditya Tibrewal has agreed to deliver a certain amount as illegal gratification and requested Ashok Kumar Gupta to get it collected through some of his representatives by sending him at Khar/Andheri. Aditya Tibrewal has further directed one of his known people to handover the bribe money to the representative of Ashok Kumar Gupta in next two or three days after his confirmation.

Thus, the above information prima facie discloses the commission of offences punishable under Section 120B IPC and Section 7, 9, 10 & 11 of the Prevention of Corruption Act, 1988 (as amended in 2018) on the part of (i) Ashok Kumar Gupta, Principal Chief Mechanical Engineer, Central Railway, Chhatrapati Shivaji Maharaj Terminus (CSMT), Mumbai, (ii) M/s. Anand Sales Corporation, at 9th Floor, B Block, 113, Park Street, Poddar Point, Kolkata-700016 (iii) Aditya Tibrewal, partner of M/s. Anand Sales Corporation at 9th Floor, B Block, 113, Park Street, Poddar Point, Kolkata – 700016, and other unknown public servants/private persons.

Hence, in view of the above and after obtaining the specific consent from the Government of Maharashtra U/S. 6 of DSPE Act, 1946 vide No : CBI 1622/C.R. 746/POL-2 dated 22.09.2022, a Regular Case no. RC0262022A0015 is registered on 24.09.2022 and entrusted to Ranjeet Kumar Pandey, Police Inspector, CBI, ACB, Mumbai for investigation.
