Amit Shah Likely to Move Bills on J&K Reservation Act, Reorganisation Act in Lok Sabha – News18

The Jammu and Kashmir Reorganisation Act, 2019 provides for the reorganisation of the state of Jammu and Kashmir into the union territories of Jammu & Kashmir and Ladakh. The bill increases the total number of seats in the Jammu and Kashmir Legislative Assembly from 83 to 90

The Bill to amend the Jammu and Kashmir Reservation Act 2004 and the Jammu and Kashmir Reorganisation Act 2019 is likely to be moved by Union Home Minister Amit Shah in the Lok Sabha on Tuesday.

The Jammu and Kashmir Reservation Act provides for reservation in appointment in state government posts, and admission to professional institutions, for certain reserved categories. It provides for reservation in professional institutions for economically weaker sections.

The Jammu and Kashmir Reorganisation Act, 2019, meanwhile, provides for the reorganisation of the state of Jammu and Kashmir into the union territories of Jammu and Kashmir and Ladakh. The bill increases the total number of seats in the Jammu and Kashmir Legislative Assembly from 83 to 90. It also reserves seven seats for Scheduled Castes and nine seats for Scheduled Tribes.

Here’s a look at what the Jammu and Kashmir Reorganisation Act provides for:

  • L-G can nominate one member to the Assembly from the displaced people of Pakistan-occupied J&K
  • L-G can also nominate two members (mandatorily one shall be woman) from the Kashmiri migrants to be a member of J&K Legislative Assembly

The Act is proposed to be amended with a view to provide representation to ‘Kashmiri Migrants’, ‘Displaced Persons from Pakistan-occupied Jammu and Kashmir’ and Scheduled Tribes in the J&K Assembly to preserve their political rights as well as for their overall social and economic development.

According to the legislation’s text, the term ‘Migrant’ shall have the same meaning as assigned to it in clause (e) of section 2 of the Jammu and Kashmir Migrant Immovable Property (Preservation, Protection and Restraint on Distress Sales) Act, 1997.
