Azam Khan has got a big relief in the hate speech case. On Wednesday, the Special MP/MLA Court of Rampur acquitted Azam. Azam was sentenced to 3 years in this case by the lower court of MP/MLA court. After the sentence, his legislature had gone. After this, a by-election was held on this seat, in which the BJP leader who filed a case against Azam was elected as MLA.

Advocate Zubair Ahmed told that Azam has been acquitted by the MP/MLA court. Rejecting the evidence on the basis of which the lower court had awarded the sentence, the upper court acquitted Azam with dishonor after about 7 months.

Azam was sentenced on 27 October 2022 in the hate speech case. The court had also imposed a fine of Rs 25,000 on Azam. This matter is of 2019. Then the Lok Sabha elections were being held in the country.

SP leader Azam Khan had reached Rampur’s Milak assembly constituency to address an election meeting at that time. There was a huge crowd at the meeting place. Azam Khan had allegedly made objectionable and provocative comments in the election meeting. On which the opposition parties created a ruckus.

Meanwhile, BJP leader Akash Saxena had given a complaint against him in the police station. Acting on which the police had registered a case against Azam Khan at Milak Kotwali for violating the code of conduct and giving provocative speech. After investigation by the police, the matter reached the MP-MLA court of Rampur.

By-elections were held on December 5, 2022 on Rampur City seat after Azam Khan went to the Legislature. The result was declared on December 7, in which BJP candidate Akash Saxena defeated Asim Raza, close to Azam, by 25,703 votes.

Even before this, Akash Saxena had contested against Azam in 2022 from Rampur assembly seat, though he lost. Akash is a direct party against Azam in 43 cases so far.

Legislative will not be restored
Senior High Court lawyer CB Pandey says that nothing can happen on the legislature of former minister Azam Khan. In the Maharashtra government case, the Supreme Court had said that after the speaker has canceled the membership of the MLAs, they cannot be reinstated. Similarly, Azam Khan’s legislature cannot be restored in the hate speech case. But Azam would have been sentenced to 2 or more than 2 years in any other case. Then his membership and the ban on contesting elections for 6 years will not be removed.

Azam has been sentenced to 2 years for blocking the road
Apart from the hate speech case, on February 13, 2023, the Moradabad court sentenced Azam and his son Abdullah Khan to 2 sentences. In fact, on January 29, 2008, Azam was stopped by the Moradabad police. During this Azam got angry and sat on the road. After that, a case was registered against supporters including Azam Khan and his son for obstructing government work and blocking the road.

Azam Khan remained in jail for 27 months in different cases. He was granted interim bail by the Supreme Court on 19 May 2022. After this, on the morning of May 20, he was released from Sitapur District Jail. During this his sons Abdullah Azam, Adeeb Azam and SP leader Shivpal Yadav were also present.

Questions have also been raised on Azam’s dream project Johar University. It is alleged that Azam misused his influence to make Johar University. Azam has been MLA for 10 times from Rampur assembly seat.
