No relief to Manish Sisodia from SC: CJI said- go to High Court to get bail, coming directly to Supreme Court is not a good tradition

Sisodia was arrested by the CBI on Sunday after 8 hours of questioning in the liquor policy case. On Monday, the court sent him on remand for 5 days.

Former Delhi Deputy CM Manish Sisodia, who is on CBI remand in the Liquor Policy case, did not get relief even from the Supreme Court. According to the news agency, the CJI’s bench reprimanded him for coming directly to the Supreme Court and said that you go to the High Court, what is the meaning of coming directly to us. We cannot promote a wrong tradition.

Congress leader and senior advocate Abhishek Manu Singhvi had moved a petition for urgent hearing on Tuesday morning against Sisodia’s arrest, which was accepted by the court. A bench of CJI Justice DY Chandrachud and Justice PS Narasimha heard the case at 4 pm.

The bench said – just because the matter is of Delhi, we cannot interfere in it. You should go to the High Court. You have many other legal options. Why are you seeking bail directly from the Supreme Court? This is not a good tradition. We are dismissing the petition.

While going for questioning on Monday, Manish Sisodia said – We are not afraid of police, CBI, ED or jail, but BJP people are afraid of Sisodia and Kejriwal.

Singhvi’s argument and court’s harshness
Sisodia’s lawyer Abhishek Singhvi, citing the Vinod Dua case, demanded an urgent hearing from the court in the morning, which was accepted. In June 2021, the Supreme Court quashed the sedition case against journalist Vinod Dua over his criticism of the Centre’s handling of the Corona pandemic. Dua had come directly to the Supreme Court.

On Tuesday evening, when the Supreme Court started hearing on Sisodia’s petition, it said – Vinod Dua case has nothing to do with his case. The journalist’s case was about freedom of speech and expression, while Sisodia’s case is about alleged corruption.

Singhvi said- Sisodia’s arrest is wrong, because his name was not in the CBI charge sheet. The CBI’s excuse is that Sisodia is not cooperating in the investigation. On this CJI Chandrachud said – go to the High Court. Our doors are open, but we are not ready to hear it at this stage.

Justice PS Narasimha said, this would be a very wrong precedent. You cannot do this just because you are in Delhi.

CBI arrested after 8 hours of questioning
CBI is questioning Sisodia. Earlier, CBI had arrested Sisodia after 8 hours of questioning on Sunday in the liquor policy case. He was produced in Delhi’s Rouse Avenue Court at around 2.30 pm on Monday afternoon. The CBI had sought a 5-day remand of Sisodia from the court, which was accepted by the court.

CBI’s argument- Sisodia is not cooperating in the inquiry
The CBI had told the Delhi court that Sisodia was not cooperating in the investigation. They are giving roundabout answers to every question, so their 5-day remand is needed. Sisodia’s lawyer opposed it. His argument was that sending a deputy CM on remand would send the wrong message. However, accepting the arguments of the CBI, the court remanded Sisodia till March 4.

Digital device, liquor policy draft report and officer’s statement, 4 reasons for Sisodia’s arrest…

  1. It is being told in the reports quoting CBI sources that on August 19 last year, the CBI investigated the Delhi Excise Department. A digital device was seized from there. From this device, CBI came to know that a document of liquor policy was sent to a system which was not in the network of excise department.
  2. After this, the CBI called the officer of the Excise Department for questioning. The officer provided details of a system, which was seized by the agency from Sisodia’s office on January 14 this year. Most of the files in this system were deleted, but with the help of the forensic team, the CBI retrieved the data. Forensic investigation revealed that the document was made from outside and received on WhatsApp.
  3. After getting this information, the CBI called the 1996 batch bureaucrat for investigation. This bureaucrat had worked as the secretary of Sisodia. According to sources, the officer told the CBI that in March 2021, Sisodia had called him to Kejriwal’s office. There the minister’s report on the draft liquor policy was given to the officer. Satyendar Jain was also present during this.
  4. The officer told that the rule of 12% profit margin came from this draft report itself. No record was found of any discussion for this rule, or any file related to it. On Sunday, CBI questioned Sisodia about this draft report but Sisodia refused to share the information. The officer’s statement was recorded before a magistrate in early February.
